Appeal of

LYNN SUSAN MANCINI

Under Contract No. HCR 32696

PSBCA No. 4129

APPEARANCE FOR APPELLANT:

Leonard H. Klatt, Esq.

APPEARANCE FOR RESPONDENT:

Glenn L. Smith, Esq.

OPINION OF THE BOARD ON MOTION FOR RECONSIDERATION

Appellant has filed a motion asking the Board to reconsider its original Opinion, Lynn Susan Mancini, PSBCA No. 4129, 99-2 BCA ¶ 30,577.  Respondent did not reply to the motion.

In her motion, Appellant makes two one-sentence statements.  First, Appellant states that the Board's decision was "contrary to the law of contract and to the specific terms of the contract under review."  In the second statement, Appellant repeats the argument she made in the original appeal that the contract administrator had no authority to require her to submit medical evaluations, but should have allowed her to resume performance when she indicated she was ready to do so.  Appellant adds nothing to either of these statements, nor does she provide any details to support them.

Under the Board's Rules of Procedure, a motion for reconsideration is required to "…set forth specifically the ground or grounds relied upon…."  Further, where a party merely repeats arguments that were previously made and considered, there is no basis for reconsideration.  The General Store, PSBCA No. 3951, 99-1 BCA ¶ 30,124; Patricia J. Stevens, PSBCA No. 3272, 94-2 BCA ¶ 26,951.

In this instance, Appellant's first statement is the equivalent of simply stating that she disagrees with the original Opinion, without offering any specific grounds.  Appellant's second statement merely repeats a previously made and considered argument.  Neither statement shows any factual or legal errors made by the Board that would warrant changing our decision.

Accordingly, the motion for reconsideration is denied and the original Opinion is affirmed.
