INITIAL DECISION
A Notice of Docketing of Petition for this case was issued on July 7, 2004. The Notice stated that an Answer was to be filed by the Postal Service within 30 days of receipt of the Notice. The Notice was received by Respondent’s representative on July 12, 2004.
On August 17, 2004, no Answer having been filed, an Order was issued, stating that if Respondent intended to contest this case an Answer or other appropriate pleading must be received in this office by August 25, 2004. Respondent’s representative received that Order on August 22, 2004.
Respondent filed nothing. By Order dated August 27, 2004, Respondent was directed to show cause by September 8, 2004 why this Petition should not be granted based on Respondent’s failure to file a timely Answer. Respondent’s representative received that Order on August 30, 2004, but filed nothing.
The Petition is granted. Respondent may not collect money from Petitioner for the debt alleged in this case. Any money withheld from Petitioner on account of this alleged debt shall be returned to him.
