INITIAL DECISION

By Order dated February 19, 2003, Respondent was granted a 30-day extension, to March 19, 2003, for filing an Answer to the Petition.  No Answer was filed.  An Order dated March 26, 2003 stated that an Answer or other appropriate pleading must be received in this office by April 4, 2003, if Respondent intended to contest this case.  Respondent filed nothing.

            By Order dated April 8, 2003, Respondent was directed to show cause by April 18, 2003 why the Petition should not be granted based on Respondent’s failure to file a timely Answer.  Respondent filed nothing in response to this Order, but on April 28, 2003, filed an Answer and Motion for Summary Judgment.

            Based on Respondent’s failure to file a timely Answer and failure to respond to the Order to Show Cause, the Petition is granted.  Respondent may not terminate Petitioner’s post office box service based on this case file.
