POSTAL SERVICE DECISION
On March 7, 2003, Tentative Decision and Order No. 03-10 (Tentative Decision) was issued, in which it was concluded that Complainant had made a prima facie showing that the orders authorized by 39 U.S.C. §3005(a) should be issued against Respondent. On April 21, 2003, Respondent filed a timely reply to the Tentative Decision in which it advised that it has resolved this matter by removing the complaining addressee from its mailing list.
Respondent has not shown good cause for dismissing the Complaint. Although Respondent may have removed the complaining addressee from its mailing list, it has not shown that it did not previously, or that it is not now, using the United States mail to promote a lottery, gift enterprise, or scheme for the distribution of money by lottery, chance, or drawing within the meaning of 39 U.S.C. §3005.
Accordingly, pursuant to 39 C.F.R. §952.7(b), Tentative Decision and Order No. 03-10 is now the Final Decision and Order of the Postal Service.
