ORDER AND MEMORANDUM OF TELEPHONE CONFERENCE
On December 9, 2002, Staff Counsel Diane M. Mego initiated a telephone conference with Disputants Stephen J. Phillips and Dennis Norris. Ms. Mego also attempted to contact Disputant Nancy Norris, but was unable to reach her. The parties confirmed that the mail being held had been released to Mr. Phillips and that he had divided the mail between him and the Norrises. Although the mail was improperly released to Mr. Phillips, Mr. Norris stated that while he was not convinced that he had gotten all the mail he was entitled to receive, he did not intend to appeal the Initial Decision which was issued on November 6, 2002.
Since no appeal has or will be filed and the Judicial Officer has determined he will not exercise his discretion to review the Initial Decision on his own motion, the Initial Decision has become final.
