MEMORANDUM OF TELEPHONE CONFERENCE
AND DISMISSAL
By letter dated September 12, 2001, Timothy J. Andringa, Esq., representing Disputants Moreland Investments II, LLC and Charles Slater (hereinafter "Disputant Moreland"), notified the Judicial Officer that Disputant Moreland and Disputants Kshama Corporation and Narendra R. Patel (hereinafter "Disputant Kshama") had reached a settlement agreement concerning all mail currently being held and hereafter received addressed to 2202 E. Moreland Boulevard, Waukesha, WI 53186-2972. On September 19, 2001, Staff Counsel Diane M. Mego initiated a telephone conference with Mr. Andringa and Harvey Jay Goldstein, Esq., representing Disputant Kshama, to confirm the terms of the settlement.
The parties stated that Disputant Phillip A. Mendel was no longer involved in this dispute and was not a party to the settlement.1 The parties have agreed that all mail currently being held by the Waukesha, WI Postmaster should be delivered as directed by Mr. Andringa. The parties agree that Mr. Andringa will inspect the mail and retain any mail intended for Disputant Moreland and forward any mail intended for Disputant Kshama to that Disputant. If Mr. Andringa is unable to determine for whom the mail is intended, he will send a photocopy of the outside envelope to Mr. Goldstein for his inspection. If Mr. Andringa and Mr. Goldstein are still unable to determine for whom the mail is intended, that mail will be opened in each other’s presence. Finally, if the parties cannot agree who is entitled to the mail after it is opened, they will resolve the dispute through the bankruptcy proceeding. The parties have further agreed that any mail hereafter received is to be delivered as addressed to 2202 E. Moreland Boulevard, Waukesha, WI 53186-2972.
Accordingly, by the attached Order the Waukesha, WI Postmaster is being directed to deliver the mail in accordance with the parties’ agreement and the mail dispute is hereby dismissed.
The parties are reminded that their settlement determines only the right to delivery of the mail in dispute, not the ownership of the mail. If either party receives mail intended for the other, or for Disputant Mendel, that party is responsible for forwarding such mail to the intended recipient.
At the parties’ request, this Memorandum of Telephone Conference and Dismissal is being sent by facsimile.
