FINAL DECISION UNDER THE DEBT COLLECTION ACT OF 1982
By Orders dated April 6 and 24, 2001, Petitioner was directed to provide information to complete her request for a hearing. She was also directed to provide home and work telephone numbers so that this office could contact her. The April 24 Order advised Petitioner that if she failed to respond she would be considered to have waived her right to a hearing and Respondent would be entitled to begin the offset it proposed in the March 27, 2001 Notice of Involuntary Administrative Salary Offsets. The April 24 Order was sent by certified mail, but it was returned by the post office because Petitioner did not claim it. The Order was sent again on May 24, 2001, this time by First Class mail, not certified, but Petitioner still has not responded.
For her failure to respond to the orders of the Hearing Official, Petitioner has waived her right to a hearing. Respondent is entitled to offset her pay in accordance with the March 27, 2001 Notice of Involuntary Administrative Salary Offsets. See 39 C.F.R. §961.10 (c).
