On February 14, 2001, an Administrative Law Judge issued an Initial Decision in which he granted Respondent’s Motion to Dismiss. Since no appeal has been filed and the Judicial Officer has determined he will not exercise his discretion to review the Decision on his own motion, the Decision on Motion to Dismiss has become the final agency decision as provided in 39 C.F.R. §966.11.
