FINAL DECISION UNDER THE DEBT COLLECTION ACT OF 1982
Petitioner, Leonora R. Brown, filed a Petition under the Debt Collection Act of 1982, as amended, 5 U.S.C. §5514(a), after receiving a Notice of Involuntary Administrative Salary Offsets dated February 5, 2000. The Notice stated Respondent's intent to withhold $244.00 from Petitioner's salary, pursuant to a notification dated June 29, 1999.
Following a telephone conference in this matter with Petitioner and the undersigned, Respondent's representative telephoned a staff member in this office and stated that Respondent did not intend to pursue the matter any further, but that the representative did not intend to file anything in writing. By Order dated March 22, 2000, Respondent was advised that, based on that telephone message, the Petition would be granted unless Respondent objected within 10 days of receipt of the Order. Respondent received the Order on March 28, and did not file any objection to granting the Petition.
Accordingly, the Petition is granted. Respondent may not withhold the $244.00 from Petitioner's salary.
