DISMISSAL
Petitioner is no longer an employee of Respondent, having retired on or about March 1, 2000. Accordingly, the Debt Collection Act procedures of 39 C.F.R. Part 961, applicable to debts alleged to be owed by current Postal Service employees, are no longer appropriate for considering Petitioner’s challenge to Respondent’s collection. Therefore, P.S. Docket No. DCA 00-57 is dismissed.
However, Respondent has confirmed its intention to continue its collection against Petitioner’s retirement annuity. Therefore, Petitioner’s appeal from collection of the debt will be redocketed as an Administrative Offset proceeding pursuant to 39 C.F.R. Part 966. The record established in P.S. Docket No. DCA 00-57 is incorporated into the record for the Administrative Offset proceeding and the schedule for the hearing shall remain unchanged.
