O R D E R

On July 15, 1998, an Initial Decision was issued in which it was concluded that all mail currently being held or hereafter received addressed to Systems Balancing, Inc., or SBI Systems Balancing, Inc. (or to variants of those names that include "SBI" but do not include the term "HVAC"), is to be delivered as directed by the Moodys, that mail addressed to a version of the business name containing "HVAC" is likely intended by the sender for delivery to the Stricklins' businesses, and such mail should be delivered accordingly, and that all other business mail addressed to 11403 Grapewood Dr., Houston, TX 77089-5412, should be delivered as addressed. Attached to the Initial Decision was a proposed order reflecting the conclusions reached in the Initial Decision. However, the proposed order did not completely reflect the holding in the Initial Decision. The proposed order stated only that it applied to mail addressed to Systems Balancing, Inc., or SBI Systems Balancing, Inc., but did not include the parenthetical covering names that are variants of SBI but do not include HVAC.

Although no appeal has been filed, the Judicial Officer has determined to exercise his discretion to modify the proposed order so that it accurately reflects what was held in the Initial Decision and supported by the record. Mail addressed to Systems Balancing, Inc., or SBI Systems Balancing, Inc. (or to variants of those names that include "SBI" but do not include the term "HVAC"), is to be delivered as directed by the Moodys. The final order has been revised to reflect this modification.

The parties are reminded that a decision in a mail dispute determines only the right to delivery of the mail in dispute, not the ownership of the mail. If either of the parties receives mail intended for the other, that party is responsible for forwarding such mail to the intended recipient.
