O R D E R
On October 3, 1997, Tentative Decision and Order No. 97-83 was issued which concluded that in accordance with 39 C.F.R. §952.7(b), the orders authorized by 39 U.S.C. §3005(a) should be issued against Respondent. Accompanying the Tentative Decision and Order was a "Notice of Tentative Decision and Order" which advised Respondent that unless it presented good cause for dismissing the Complaint within 45 days of the date of the Tentative Decision and Order, the Tentative Decision and Order would become final.
Respondent filed a response to the Tentative Decision and Order stating that he is an authorized agent of the South German Class Lottery (SKL), that he does not advertise the SKL in those countries in which such advertising is forbidden, and that he is only corresponding with a former participant in the SKL. However, he has not shown good cause for dismissing the Complaint within the time allowed. Specifically, Respondent has not denied that he is engaged in conducting a lottery enterprise and that he solicited remittances through the United States mail for participation in that lottery, which is a violation of 39 U.S.C. §3005.(1) Therefore, in accordance with 39 C.F.R. §952.7(b), Tentative Decision and Order No. 97-83 is now the Final Decision and Order of the Postal Service.
