INITIAL DECISION

            This mail dispute has been forwarded for resolution by the USPS Office of Field Legal Services, Atlanta, GA pursuant to Domestic Mail Manual (DMM) §153.72 and 39 CFR Part 965.

            Neither disputant has filed the submittal required by 39 CFR §965.5.

            The mail in dispute is addressed to Robert or Robert A. Suarez at 2B E. Lexington Ln., Palm Beach Gardens, FL  33418-7119.  The documentation forwarded by the Office of Field Legal Services furnishes no basis for determination that either disputant is entitled to receive the disputed mail.  Consequently, there is no alternative to issuance of an order directing the Postmaster to return the disputed mail to sender, marked "In Dispute."

            The issuance of such an order will not prevent the disputants from agreeing that the disputed mail be delivered to a named receiver or third party for distribution to the appropriate person and filing such agreement with the Recorder with a request that the Judicial Officer issue to the Postmaster an order incorporating such agreement.

            The attached order should be issued.
