This mail dispute has been forwarded for resolution pursuant to Domestic Mail Manual (DMM) § 153.72 and 39 C.F.R. Part 965. The parties dispute the right to delivery of mail addressed to Maryland Insurance Finance Company, 16101 Shady Grove Road, Gaithersburg, MD 20877.

Mr. DePristo has made a timely submission pursuant to § 965.5 of the Rules of Practice. Mr. Goldstein has not filed a submission under that rule. Pursuant to § 965.7 of the rules, Mr. Goldstein may be held in default for failure to file the required submittal and an initial decision may be issued in favor of Mr. DePristo.

1. Disputant Barry DePristo is president of Maryland Insurance Finance Company, a Maryland corporation.

2. Disputant Goldstein's claim that he is president of the corporation is not supported by a sworn submission pursuant to the Rules of Practice or other credible evidence.

When a dispute arises between officers or others connected with a corporation over mail addressed to it, the mail is to be delivered in accordance with the order of the president of the corporation (DMM § 153.51). Accordingly, mail addressed to Maryland Insurance Finance Company at 16101 Shady Grove Road, Gaithersburg, MD 20877 (or other street address) is to be delivered to Barry DePristo or as directed by him.

Disputant Goldstein is in default in this proceeding.
