This mail dispute was docketed under Domestic Mail Manual § 153.72, which requires regional counsel to forward unresolved mail disputes to this Department for decision. Neither party has filed a submittal pursuant to 39 C.F.R. § 965.5, although each party received notice from the Recorder of the requirement to file "a sworn statement of the facts supporting its claim together with a copy of each document on which it relies in making such claim." This decision will be based on the documents provided the Postmaster which were forwarded to this Department by regional counsel.
Based on the documents in the file, all rights and interest in the partnership known as Eagle Realty were transferred to disputant Bacchetta by deed dated July 20, 1987. Disputant Bacchetta subsequently registered with the County Clerk a fictitious business name statement for Eagle Realty on December 1, 1988. The partnership papers and fictitious business name statement filed by disputant Hagman all predate the deed transferring the interests in the business to disputant Bacchetta. The rights and interest in Eagle Realty which have vested in disputant Bacchetta include the right to receive mail addressed to Eagle Realty.
Accordingly, all mail addressed to Eagle Realty at 354 E. Palm Street, Burbank, CA 91502-1229, should be delivered to disputant Bacchetta. Also, mail addressed to Eagle Realty at 600 E. Olive Avenue, Burbank, CA 91501-2139, should be delivered to disputant Bacchetta.
