POSTAL SERVICE DECISION

ON PETITION FOR SUPPLEMENTAL ORDERS

Prior proceedings in this matter led to the issuance of False Representation Order No. 85-2 and Cease and Desist Order No. CD-l84, dated January l0, l985, and False Representation Order No. 85-47 and Cease and Desist Order No. CD-333 dated May 30, l985. On August 5, l985, Complainant filed a Petition for Supplemental Order and Cease and Desist Order, with attachments, alleging in effect that Respondent has resumed the activities proscribed by the Cease and Desist Orders and as a result is evading or attempting to evade the provisions of the False Representation Orders. According to Complainant, Respondent is conducting the same or a similar scheme under the name Tourism Information Services, P. O. Box 350187, Tampa Florida 33695-0l87. Complainant requests that a supplemental False Representation Order be issued against this business name and address and that a supplemental Cease and Desist Order be issued against Respondent and one of his employees, agents or representatives.

By Notice dated August 7, l985, Respondent was advised that if he intended to oppose the Petition for Supplemental Orders he should file his Answer no later than ten calendar days from the date of receipt of the Petition. No Answer to the Petition has been filed within the time allowed, or as of the date of this Decision.

By the Petition and the attachments thereto, a prima facie showing has been made that Respondent is evading or attempting to evade the provisions of the previously issued False Representation Orders by conducting the same or a similar scheme under a different name and at a different address and that he and one of his employees, agents or representatives is engaged in activities proscribed by the previously issued Cease and Desist Orders. Accordingly, a supplemental False Representation Order against Respondent under the name and at the address alleged in the Petition and a supplemental Cease and Desist Order against Respondent and one of his employees, agents or representatives are being issued with this Decision.
