Docket No. 20/64; 05/30/85 Cohen, James A. APPEARANCE FOR COMPLAINANT: H. Richard Hefner, Esq. Respondent to an A. Potter, Esq. Consumer Protection Division Law Department United States Postal Service Washington, DC 20260-1112 APPEARANCE FOR RESPONDENT: Nick Inman P. O. Box 350218 Tampa, FL 33695-0218
Prior proceedings in this matter led to the issuance of False Representation Order No. 85-2 and Cease and Desist Order No. CD-184, both dated January 10, 1985. On May 1, 1985, Complainant filed a Petition for Supplemental Order and Cease and Desist Order, with attachments, alleging in effect that Respondent is evading or attempting to evade the provisions of the False Representation Order, and has resumed the activities proscribed by the Cease and Desist Order. According to Complainant, Respondent is conducting the same or a similar scheme under the name Tourism Personnel Services, P. O. Box 350218, Tampa, Florida 33695-0218. Complainant requests that a supplemental Cease and Desist Order and False Representation Order be issued against this name and address.
By Notice dated May 2, 1985, Respondent was notified that if it intended to oppose the Petition for Supplemental Orders it should file its Answer no later than ten calendar days from the date of receipt of the Petition. The Petition was served on Respondent on May 6, 1985. No Answer to the Petition has been filed within the time allowed, or as of the date of this Decision.
By the Petition and the attachments thereto, a prima facie showing has been made that Respondent is evading or attempting to evade the provisions of False Representation Order No. 85-2 by conducting the same or a similar scheme under a different name and at a different address and that it is engaged in activities proscribed by Cease and Desist Order No. CD-184. Accordingly, a supplemental Cease and Desist Order and a supplemental False Representation Order against Respondent under the name and at the address alleged in the Petition are being issued contemporaneously with this Decision.
