POSTAL SERVICE DECISION

ON BREACH OF CONSENT AGREEMENT

On January 19, 1984, Complainant filed a Petition for Orders Based on Breach of Consent Agreement alleging that Respondents have breached the terms of a Consent Agreement executed on August 4, 1983, by Daryl Stenger on behalf of himself and the captioned Respondents. Complainant contends that Respondents have breached the terms of the Consent Agreement by resuming the activities which they agreed in the Consent Agreement to discontinue. The name and addresses which Complainant alleges Respondents use in conducting the resumed activities are: CENTURY MARKETING, INC., at Box 3611, Pompano Beach, Florida 33072-3404 and at 602 South Ocean Boulevard, #3, Pompano Beach, Florida 33062-6312.

On January 20, 1984, an interim detention order as provided for in paragraph 3 of the Consent Agreement was issued. The interim detention order granted Respondents a period of ten days in which to file a reply to the Petition. No reply has been filed by Respondents. In the absence of a reply, the allegations of the Petition are deemed to be admitted. These allegations, which are supported by the attachments to the Petition, make a prima facie showing that Respondents have breached the terms of the Consent Agreement in the manner alleged in the Petition.

Accordingly, pursuant to the terms of the Consent Agreement, an Order under 39 U.S.C. § 3005 is being issued with this Decision.
