Respondent's Motion for Reconsideration of the Postal Service Decision on Breach of Consent Agreement (March 12, 1984) requests elimination or replacement of the finding of privity between Performance Productions, Inc. and Box Office, Inc. Respondent's arguments are essentially the same as those advanced with respect to the privity issue in its opposition to the amended Petition for Order Based Upon Breach of Consent Agreement. All of these arguments were considered in arriving at the Postal Service Decision.
As correctly pointed out by Complainant, deciding the privity issue was essential to reaching the merits of the breach allegations.
Respondent has shown no persuasive reason for altering the Postal Service Decision.
The motion for reconsideration is denied.
