In the Matter of the Complaint Against INTER-BAY DISTRIBUTING COMPANY P. O. Box 1786 and DEEP SOUTH DISTRIBUTING COMPANY, INC. P. O. Box 247 at Pinellas Park, FL 33565 P.S. Docket No. 11/88; 05/14/82 Cohen, James A. APPEARANCES FOR COMPLAINANT: SandraC. McFeeley, Esq. Clark C. Evans, Esq. Consumer Protection Division Law Department United States Postal Service Washington,DC 20260 APPEARANCE FOR RESPONDENT: No Appearance
Prior proceedings in this matter led to the issuance of False Representation Order No. 81-128, dated June 25, 1981, and False Representation Order No. 81-213, dated October 9, 1981, against mail addressed to Respondents at the captioned addresses. On April 27, 1982, Complainant filed a Petition for Supplemental Order, with attachments, alleging in effect that Respondents are evading or attempting to evade the provisions of the False Representation Orders, by conducting the same or a similar scheme under the name Deep South Distributing Company, Inc., at P. O. Box 2041, Pinellas Park, Florida 33565. Complainant requests that a False Representation Order be issued against this name and address.
By Notice dated April 28, 1982, Respondents were notified that if they intended to oppose the Petition for Supplemental Order they could file their Answer not later than 10 calendar days from the date of receipt of the Petition. The Petition was served on Respondents on April 30, 1982. No Answer to the Petition has been filed within the time allowed or as of the date of this Decision.
By the Petition and the attachments thereto, a prima facie showing has been made that Respondents are evading or attempting to evade the provisions of False Representation Order Nos. 81-128 and 81-213 by conducting the same or a similar scheme which is the subject of the Orders at a different address. Accordingly, a Supplemental False Representation Order against Respondents at the address alleged in the Petition is being issued contemporaneously with this Decision.
