POSTAL SERVICE DECISION ON BREACH OF CONSENT AGREEMENT

On August 27, 1981, Complainant filed a "Petition for Order Based upon Breach of Consent Agreement" in which it alleges that Respondent has breached the terms of a Consent Agreement executed on December 16, 1980. On August 31, 1981, Complainant filed a motion to correct the Petition with respect to one address. The motion was properly served on Respondent and no opposition to the motion having been filed, it is hereby granted.

In its Petition, Complainant sought the issuance of a temporary detention order. On the basis of information attached to the Petition, a temporary detention order was issued on September 2, 1981. Complainant also seeks issuance of a Mail Stop Order as authorized by the Consent Agreement and 39 U.S.C. § 3005 against:

By Ordere of September 2, 1981, Respondent was granted a period of 10 days in which to respond to Complainant's Petition. No response has been filed by Respondent.

Complainant has made a prima facie showing that Respondent has breached the Consent Agreement in the manner alleged in the Petition. Accordingly, pursuant to the terms of the Consent Agreement, an Order under 39 U.S.C. § 3005 is being issued contemporaneously with this Decision.
