POSTAL SERVICE DECISION

ON BREACH OF CONSENT AGREEMENT

On June 10, 1981, Complainant filed a "Petition for Mail Stop Order Based upon Breach of Consent Agreement" in which it alleges that Respondent has breached the terms of a Consent Agreement executed on its behalf by Michael DiStephano on March 29, 1981. In its Petition, Complainant sought the issuance of a Temporary Detention Order. On the basis of information forwarded with the Petition, a Temporary Detention Order was issued on June 11, 1981. On June 12, 1981, Complainant filed a "Motion to Amend Order" in which it requested that the Temporary Detention Order of June 11, 1981, be amended to delete "Dept. SW-91" from Respondent's address. Respondent was given an opportunity to respond to the Motion. No such response has been filed and the amendment requested is granted. Accordingly, the Temporary Detention Order is amended to delete "Dept. SW-91" from Respondent's address. The amended address is also incorporated in the Order attached hereto.

Complainant also seeks issuance of a Mail Stop Order as authorized by the Consent Agreement and 39 U.S.C. § 3005. By Order of June 11, 1981, Respondent was granted a period of 10 days in which to respond to Complainant's Petition. No response has been filed by Respondent.

Complainant has made a prima facie showing that Respondent has breached the Consent Agreement in the manner alleged in the Petition. Accordingly, pursuant to the terms of the Consent Agreement, an Order under 39 U.S.C. § 3005 is being issued contemporaneously with this Decision.
