POSTAL SERVICE DECISION ON MOTION FOR RECONSIDERATION

Respondent, by its letter dated October 9, 1980, with attachments, in effect requests reconsideration of the Postal Service Decision dated September 25, 1980. In support of its request for reconsideration Respondent seeks to have considered the attachments to its letter which it contends support its position that it is not in violation of 39 U.S.C. § 3005.

Respondent was previously granted an opportunity to present evidence to challenge the allegations of the Complaint but chose not to do so. The attachments to its letter which Respondent now seeks to have considered as evidence in this proceeding have not been shown to have been previously unavailable. Accordingly, they will be be considered at this time. Moreover, even if considered, the attachments would not serve as a basis for altering the Initial Decision or the Postal Service Decision.

The arguments made by Respondent in its letter of reconsideration were previously addressed in the Initial Decision or the Postal Service Decision and Respondent has not established that either decision is in error. It's request for reconsideration is, therefore, denied.
