Respondent seeks modification or revocation of Mail Stop Order No. 79-24 issued pursuant to Postal Service Decision dated April 13, 1979. Respondent claims it has changed its advertising to conform to what it considers to be "federal standards." In support of its position Respondent has submitted a revised copy of its circular entitled "Your Chance to Make a Stack of Cash," which advertises the availability of an "Instruction Kit" for $13.20.
Complainant opposes Respondent's request. Complainant alleges that Respondent's classified advertisement continues to misrepresent that a reader will receive "free details" on how to earn "hundreds monthly stuffing envelopes," and that only cosmetic changes have been made to the circular entitled "Your Chance to Make a Stack of Cash."
A review of the revised circular supports Complainant's position. Although the revised circular no longer represents that employment is being offered, it continues to make the other representations which are alleged in the Complaint and found to be false in the Initial Decision of March 14, 1979, and affirmed in the Postal Service Decision of April 13, 1979. By continuing to make such representations Respondent is in violation of 39 USC § 3005 and, therefore, modification or revocation of Mail Stop
Order No. 79-24 is not appropriate. Accordingly, Respondent's application is denied and Mail Stop Order No. 79-24 remains in full force and effect.
