SUPPLEMENTAL ORDER

Prior proceedings in this matter led to the issuance of Postal Service Order No. 78-41 dated August 29, 1978, against mail addressed to J. GORDON DISTRIBUTORS, P.O. Box 35276, Los Angeles, California 90035.

On September 15, 1978, Complainant filed a Petition for Supplemental Order alleging in effect that Respondent's principal, Melvin Starkman, is evading or attempting to evade the provisions of Postal Service Order No. 78-41 by conducting the same or a substantially similar scheme under a different name and at a different address. The name and address under which the petition alleges the same or substantially similar scheme is being conducted and against whom the Supplemental Order is requested to be issued is FAR EAST TRADER, 7471 Melrose Avenue, Los Angeles, California 90046.

By notice dated September 18, 1978, Respondent was notified that if it intended to oppose the petition it could file its answer not later than 10 calendar days from the date of receipt of the petition. The petition was received by Respondent's counsel on September 21, 1978. No answer to the petition has been filed by Respondent although the time therefor has expired.

Accordingly the allegations of the petition, which are prima facie shown by attachments thereto, are taken as established and a Supplemental Order under 39 USC 3005 will issue forthwith as requested.
