In the Matter of the Petition by ) September 26, 1975 ) BOARD OF PUBLICATIONS OF THE ) CHRISTIAN REFORMED CHURCH ) 2850 Kalamazoo Avenue, S.E. ) Grand Rapids, Michigan 49508 ) ) Proposed Annulment of Second-Class ) P.S. Docket No. 3/33 Mail Privileges for "BIBLE STEPS ) ) TEACHER'S MANUAL" ) APPEARANCES: James Engbers, Esq. Miller, Johnson, Snell & Cummiskey 465 Old Kent Building Grand Rapids, Michigan 49502 for Petitioner Cecil Marr, Esq. Arthur S. Cahn, Esq. Law Department United States Postal Service Washington, D.C. 20260 for Respondent Lussier, Edward F.
The instant case arises out of a ruling of the Manager, Mail Classification Division, revoking Petitioner's second-class mail privileges for the publication "Bible Steps teacher's Manual". After filing of initial pleadings in this case the parties agreed that the final decision on a companion case of Petitioner, P.S. Docket No. 2/101, involving the publication "Bible Trails Teacher's Manual" would be controlling on the outcome of the instant case. This understanding was confirmed by an order issued by the Chief Administrative Law Judge on May 14, 1974.
The final Postal Service Decision in P.S. Docket No. 2/101 has now been issued holding that the publication there involved is entitled to second-class mail privileges. Accordingly, the decision of the Manager to revoke the second-class mail permit in the instant case is hereby reversed and the matter is remanded for action consistent with the holding in Board of Publications of the Christian Reformed Church, P.S. Docket No. 2/101.
