ORDER SETTING ASIDE INITIAL DECISION

AND REMANDING PROCEEDINGS

On October 3, 1973, Administrative Law Judge David J. Knight issued an Initial Decision in Florists' Transworld Delivery Association, P.S. Docket No. 1/167, holding the publication involved in that proceeding not to be a periodical publication within the meaning of former 39 U.S.C. 4351.

The parties to the above-captioned proceedings having agreed by stipulation to abide by the decision in Florists' Transworld Delivery Association on the question of periodicity, the Administrative Law Judge issued an Initial Decision in P.S. Docket Nos. 1/206 and 1/207 holding the publications involved in these proceedings not entitled to retain their second class mail privileges. The Initial Decision did not reach other issues involved in these proceedings.

On May 24, 1974, the Judicial Officer issued a Postal Service Decision in Florists' Transworld Delivery Association, P.S. Docket No. 1/167, holding the publication in that proceeding to be a periodical publication. Accordingly, the Initial Decision in P.S. Docket Nos. 1/206 and 1/207 is set aside and these cases are remanded to the Office of Administrative Law Judges for further proceedings.
