At the conclusion of the hearing in this matter it was agreed among the parties, with the consent of the presiding officer, that a period of 10 days after the hearing would be allowed in which the parties might attempt to reach a negotiated settlement of this case. It was further stipulated by Respondent's Counsel that if no such settlement could be reached, an order as provided by 39 U. S. Code 3005, would be issued against the Respondent. (Tr. 37-39)
More than 10 days have elapsed since the close of the hearing and no compromise agreement has been filed for the record.
Accordingly, based on (1) the evidence received at the hearing and (2) the stipulation by Respondent, an Order pursuant to 39 U. S. Code 3005 should be issued against this Respondent.
