The Initial Decision in the above-captioned proceeding was entered on February 2, 1973, and was sent by certified mail to Petitioner on the same day with a Notice of Right to Appeal. They have been returned by the Post Office of address endorsed to show that when delivery could not be made on February 8, 1973, because no one was at the address, a notice of the arrival of the certified mail article was left. On February 23 the mailing was returned by the Post Office to the Docket Clerk. Since the mailing was tendered on February 8, 1973, the time for appeal under the circumstances present here began to run on that dater. Since more than 15 days have elapsed since February 8, 1973, the Initial Decision issued on February 2, 1973, is now the final agency decision of the Postal Service as provided by Section 954.19(b) of the Rules of Practice (39 C.F.R. 954.19(b)).
