POSTAL SERVICE DECISION

The above-captioned proceeding is before the Judicial Officer on Respondent's appeal from the Initial Decision of the Chief Administrative Law Judge in which he sustained the allegation of the complaint. The complaint charges that Respondent is engaged in conducting a scheme or device for obtaining money or property through the mails by means of false representations in violation of 39 U.S.C. 3005 with respect to the sale of "Slim-Tabs 33". The exceptions taken by the Respondent to the Initial Decision do not raise any matters not fully covered by the Initial Decision.

I have reviewed the record of this proceeding in the light of the exceptions. On the basis of that review I find no error in the Initial Decision and that Respondent is engaged in the conduct charged. The Initial Decision is affirmed and adopted as the Postal Service Decision in this matter.

Accordingly, a remedial order under 39 U.S.C. 3005 is being issued forthwith.
