The Manager, Mail Classification Division, United States Postal Service (Respondent herein) having notified the publisher of the above-named publication of the proposed annulment of second-class mail privileges for said publication; and the publisher having filed a petition appealing from said proposed revocation; and Respondent having now moved that this proceeding be dismissed on the ground that the proposed revocation has been withdrawn for the reason that the publisher has agreed to submit the information required by 39 U.S.C. 4369 and 39 C.F.R. 132.6; and it appearing that the issues herein have been rendered moot by reason of Respondent's decision to withdraw the proposed annulment, upon the basis of assurances received from Petitioner,
IT IS ORDERED that the notice of proposed annulment of second- class mail privileges for "TIMES HERALD", dated April 12, 1972 be, and the same hereby is, set aside and that this proceeding be dismissed, without prejudice to the institution of such further proceedings as future circumstances may warrant.
