INITIAL DECISION AND

ORDER OF DISMISSAL

Upon agreement of the parties that the issues in the instant proceeding are identical to those in P.S. Docket No. 1/13, and that the Hearing Examiner's disposition of that proceeding should govern the instant proceeding, further proceedings herein were suspended by the Examiner's order of October 1, 1971, pending the issuance of a decision in P.S. Docket No. 1/13. On March 17, 1972, the undersigned Hearing Examiner issued an Initial Decision and Order in P.S. Docket No. 1/13, setting aside and dismissing the notice of proposed annulment of second-class mail privileges for Petitioner's publication. No appeal having been filed from said Initial Decision, such decision became final on April 6, 1972, pursuant to 954.19(b) of the Rules of Practice.

The parties having agreed to be bound by the outcome of P.S. Docket No. 1/13, and the decision in that case setting aside and dismissing the proposed annulment of second-class mail privileges having become final, it is appropriate to make a similar disposition of the instant proceeding. Accordingly,

IT IS ORDERED that the notice of proposed annulment of second- class mail privileges for "TV STAR PARADE", dated August 19, 1971 be, and the same hereby is, set aside and dismissed.
