DEPARTMENTAL DECISION

After the issuance of a complaint and notice of hearing, and the filing of other appropriate pleadings, this matter came on for hearing before Hearing Examiner Jesse B. Messitte. The Examiner found that Respondent makes certain representations concerning so-called "Bold Bull Tablets" advertised and sold through the

mails and he further found that the said representations are false. The Examiner recommended the issuance of a remedial order under 39 U.S. Code 4005.

Respondent has filed exceptions to five specific findings of fact and conclusions of law of the Hearing Examiner.

Upon review of (1) the pleadings, (2) the transcript of the testimony of the witnesses, (3) both briefs submitted by each party and (4) the Initial Decision of the Hearing Examiner, it is concluded that Respondent's exceptions are without merit and they must be and they are hereby disallowed.

For the reasons therein indicated, the Initial Decision is adopted as the Departmental Decision. The order provided by 39 U.S. Code 4005 will issue forthwith.
