Fraud Order No. 62-247 was issued by the Judicial Officer on November 23, 1962, against "Science of Life; John D. Hancock; P. O. Box 39673; and their officers and representatives as such, at Los Angeles, California." This fraud order followed the proper procedural steps in the above-named matter. The case came before the Judicial Officer on appeal.
A Petition for a Supplemental Fraud Order was filed by the Post Office Department on November 7, 1963, to cover the names of J. D. Medi-Formulas Distributors, and John D. Hancock, at Los Angeles, California. The Respondent filed an answer to the petition on November 26, 1963, wherein he alleges that "KLAYTAN W. KIRBY WAS DISPATCHING THROUGH THE MAILS ADVERTISING CIRCULARS FOR SALE A PRODUCT CALLED "STAGG BULLETS" AS A TREATMENT FOR THE RESTORATION OF LOSE SEXUAL VIRILITY." The Hearing Examiner in the above-named case held that the product involved was worthless for the purposes for which it was sold and the Judicial Officer of the Post Office Department sustained the decision of the Hearing Examiner.
After reviewing the letter of advertisement by the J. D. Medi-Formulas Distributors signed by John D. Hancock it is apparent that these advertisements go to people who are friends and customers of John D. Hancock. The salutation is "Dear Friend and Customer" and the first line reads "You know how good STAG BULLETS are. I don't have to tell you, because you've ordered them and I'm sure have used them by now. So--you have no doubts about the results you can get with them." The salutation and this first paragraph definitely imply what is said in the advertisement which is the basis for the complaint in the case.
Mr. Klaytan W. Kirby signed the answer to the complaint in the above-named case and all the documents by the Respondent including the recent reply to the Petition for the Supplemental Fraud Order.
The facts in the above-named case are the same--only the name on the advertisement has been changed. No good cause is shown to support a hearing on the Petition for a Supplemental Fraud Order.
A supplemental Fraud Order is hereby issued.
