O R D E R

The time for appeal in the above matter expired on October 17, 1960. No appeal having been taken from the Initial Decision of the Hearing Examiner in the above matter within the time prescribed in the Rules, the Initial Decision filed on October 10, 1960 thus becomes the Departmental Decision herein and the findings of the Hearing Examiner become final.

These findings are adopted as the findings of the Department and the Initial Decision of the Hearing Examiner, a copy of which is attached hereto, is adopted as the Departmental Decision. The matter found to be nonmailable in the decision under provisions of Section 1461, Title 18 U.S.C. shall be disposed of by the Postmaster in Chicago, Illinois under the provisions of Rule 14 of the Rules of Practice in Proceedings Relative to Mailability.

Although the fifteen days provided for in Rule 14 actually began to run on the 6th day after the filing of the Initial Decision, in order that no question may arise regarding the time allowed herein under Rule 14 the Judicial Officer will consider that the time begins to run upon the filing of this Order.

IT IS ORDERED that the matter found to be nonmailable be held for fifteen days from the date hereof. In the event the Mailer does not make application for withdrawal of such matter within said fifteen days the same shall be disposed of as nonmailable matter by the Postmaster, Chicago, Illinois as provided in 39 U.S.C. 258.
